By visiting and/ or making a purchase on our website, you acknowledge that you are at least 18 years old. You will be required to provide information and consent to the use of your information for payment processing and email marketing (where applicable).

Payments and Delivery:

We process all transactions using Shopify Pay, PayPal and all major credit and debit cards are accepted. Your order will only be confirmed when your payment has been processed and accepted, and delivery of your purchase will occur as selected during the transaction.  You will have the option of home delivery, or pick-up.  Do note that each delivery method has a different pay structure. Representation and Warranties:

WE MAKE NO WARRANTIES OR RERESENTATIONS REGARDING OUR SERVICES AND PRODUCTS IN EXCESS OF THE MINIMUM REQUIRED BY LAW.  YOU ACKNOWLEDGE THAT YOU RELEASE US FROM ANY LIABILITY EXCEEDING THE MINIMUM THE LAW MAY REQUIRED.  ALSO, YOU ACKNOWLEDGE THAT WE ARE NOT RESPONSIBLE FOR THE ACTIONS OR FAILURE TO ACT OF THIRD PARTIES THAT USE OUR PRODUCTS AND OF THIRD PARTIES THAT PROVIDE SERVICES TO OUR COMPANY.  FOR JURISDICTIONS THAT DO NOT ALLOW US TO LIMIT LIABILITY, THE ABOVE PROVISION WILL BE APPLICABLE ONLY TO THE EXTENT THAT IT CONFORMS WITH THE LAWS OF THAT JURISDICTION.

Indemnification:

You agree to indemnify and hold us harmless for any claims by you or any third-party which may arise from or relate to this Agreement or the provision of our service to you, including any damages caused by your use of our Site.

Choice of Law & Forum of Dispute:

This agreement shall be governed by Texas law. You agree that all disputes/claims/suits arising against the company will be subject to a binding arbitration in the state of Texas.

Force Majeure:

The company will not be responsible for actions or inactions due to events beyond its control, e.g. acts of God, war, insurrection riots, terrorism, crime, labor shortages, embargoes postal disruption, communication disruption, unavailability of payment processors, failure or shortage of infrastructure, shortage of produce or materials, etc.

Severability:

If a provision of this Agreement is found to be unlawful, conflicting with another provision of the Agreement, or otherwise unenforceable, the Agreement will remain in force as though it had been entered without that unenforceable provision being included in it.  If there’s a conflict with two or more provisions, the company will have the right to select which provision prevails. And the nonelection of the other provision(s) does not invalidate that provision to the extent it does not conflict with the selected provision.

Amendments:

We may amend this agreement from time to time, we will post all changes here once an amendment is completed. Endeavor to read this page each time you use our service.  Your continued use of our service constitutes your acceptance of the amendments.
